Terms of Service
Please read these terms carefully before engaging our construction services. These terms form the basis of our working relationship with you.
Last updated: 21 February 2026
These Terms of Service govern the relationship between Ago Construction ("we", "us", "our") and our clients ("you", "your") in relation to construction and renovation services provided in Oxford and Oxfordshire. Formal project contracts will take precedence where specific terms differ.
1. Acceptance of Terms
By contacting us, requesting a quote, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not engage our services. These terms apply in addition to any written project contract or specification agreed between the parties.
2. Our Services
Ago Construction provides professional construction and renovation services in Oxford, Oxfordshire, and surrounding areas, including but not limited to:
The specific scope of work for each project will be defined in the written project contract and specification documents.
3. Quotes & Estimates
- All quotes are provided free of charge and without obligation.
- Quotes are valid for 30 days from the date of issue, unless otherwise stated in writing.
- A fixed-price quote commits us to completing the specified work at the quoted price, subject to no changes to the agreed scope.
- Estimates are approximations only and may be subject to adjustment as work progresses. We will inform you promptly of any significant variation.
- All prices are quoted exclusive of VAT unless otherwise stated. VAT will be applied at the prevailing rate.
- Quotes may be revised if access to the site reveals conditions materially different from those described at the time of quotation.
4. Contracts & Agreements
A binding contract is formed when:
- You provide written acceptance (including email) of our quote or project specification, or
- A signed contract document is exchanged between both parties, or
- Work commences with your knowledge and consent following a verbal agreement.
All agreements should be confirmed in writing. We recommend clients obtain any necessary planning permissions or building regulations approval before work begins. We can advise on requirements but obtaining permissions remains the client's responsibility unless otherwise agreed.
5. Payment Terms
Payment Schedule
A deposit is typically required before work commences, with interim payments for longer projects and a final payment upon satisfactory completion. The specific payment schedule will be agreed in writing before work begins.
Payment Due Dates
Invoices are due within 14 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts Act 1998.
Accepted Methods
We accept bank transfer (BACS), cheque, and other methods as agreed. Payment details will be provided on invoices. We do not accept cash payments above £1,000.
Right to Suspend
We reserve the right to suspend work if invoices remain unpaid beyond their due date. We will provide written notice before doing so.
6. Client Obligations
To enable us to carry out work efficiently and safely, you agree to:
- Provide safe, clear, and reasonable access to the site and relevant areas at agreed times.
- Disclose any known hazards, underground services, asbestos, or other risks on the property.
- Obtain and pay for any necessary planning permissions, building regulations approvals, or neighbour consents before work begins, unless we have agreed to assist with this.
- Make timely decisions about materials, finishes, and design choices to avoid delays to the programme.
- Ensure we can liaise with a suitably authorised representative who can make decisions on your behalf during the project.
- Maintain adequate buildings and contents insurance throughout the project.
7. Changes to Work
Any changes to the agreed scope of work must be agreed in writing (including email) before additional work commences. This includes:
- Variations: Additional or altered works beyond the original specification. These will be quoted and agreed separately.
- Unforeseen works: Where hidden or unexpected conditions (e.g. structural issues, concealed pipework) require additional work, we will notify you promptly and agree on the cost before proceeding.
- Material substitutions: If specified materials are unavailable, we will advise on alternatives of equivalent quality and cost before proceeding.
8. Delays & Interruptions
Whilst we endeavour to complete all work within the agreed timeframe, we are not liable for delays caused by:
- Adverse weather conditions that make it unsafe or impractical to work.
- Supply chain disruptions or delays in the delivery of client-supplied or specified materials.
- Delays caused by the client, including late decisions, restricted access, or late payments.
- Force majeure events beyond our reasonable control (pandemic, civil unrest, natural disaster).
- Unforeseen site conditions that require additional investigation or remediation.
We will keep you informed of any delays and work to minimise disruption.
9. Workmanship Guarantee
5-Year Workmanship Guarantee
We stand behind our work. All completed construction works carry a 5-year guarantee against defects in workmanship from the date of practical completion.
This guarantee covers defects arising from faulty workmanship. It does not cover:
- Normal wear and tear
- Damage caused by misuse, negligence, or unauthorised modifications
- Defects in materials supplied by the client
- Issues arising from the client's failure to follow maintenance advice
Materials are covered by their respective manufacturer warranties. We will pass on any such warranties to you on completion.
10. Limitation of Liability
We carry full public liability insurance. Our liability to you in relation to any project is limited to the contract value of that project, except where:
- Death or personal injury is caused by our negligence (liability is unlimited).
- Liability cannot be excluded or limited under applicable law.
We are not liable for indirect or consequential losses such as loss of profit, loss of business, or loss of enjoyment arising from delays or defects, except in cases of gross negligence.
11. Cancellation
Cancellation by You
If you cancel before work commences, you may forfeit your deposit. If work has already begun, you will be liable for the value of work completed and any non-returnable materials ordered on your behalf.
Consumer clients have statutory cancellation rights under the Consumer Contracts Regulations 2013 where applicable. We will inform you of these rights when relevant.
Cancellation by Us
We reserve the right to withdraw from a project in exceptional circumstances, such as non-payment, unsafe working conditions, or discovery of serious unforeseen issues. We will provide reasonable notice and ensure you are left in a safe position.
12. Dispute Resolution
In the event of a dispute, we ask that you first contact us directly to discuss the matter. Most disputes can be resolved quickly through open communication.
If a resolution cannot be reached directly, both parties may agree to use an independent mediation service before pursuing legal action. We are committed to resolving disputes fairly and proportionately.
Consumer clients retain their statutory rights at all times, including the right to refer complaints to relevant consumer protection bodies.
13. Governing Law
These Terms of Service and any contracts entered into between us are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
